This website is operated by Swan Beauty Mirrors Pty Ltd (ABN 13 650 954 742) (“Swan Beauty”). Throughout the site, the terms “we”, “us” and “our” refer to Swan Beauty. We offer this website, including all information, tools and services available from it (the “Service”), to you on the condition that you accept these Terms of Service (“Terms”) and the policies they refer to.

By visiting our site or buying something from us, you agree to these Terms. They apply to all users of the site, including browsers, customers and contributors of content. If you don't agree to them, please don't use the site or the Service.

New features or tools added to the store are also covered by these Terms. Our store is hosted on Shopify Inc., which provides the e-commerce platform that lets us sell our products to you.

Nothing in these Terms excludes, restricts or changes any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.

1. Online store terms

By agreeing to these Terms, you confirm that you are at least the age of majority in your state or territory of residence, or that you have given us consent for any of your minor dependants to use this site.

You may not use our products for any illegal or unauthorised purpose, or break any laws in your jurisdiction (including copyright laws) when using the Service. You must not transmit any worms, viruses or code of a destructive nature. A breach of these Terms may result in us ending your access to the Service.

2. General conditions

We may refuse the Service to anyone at any time, acting reasonably.

Your content (not including card information) may be transferred unencrypted across various networks and adapted to meet the technical requirements of connecting networks or devices. Card information is always encrypted during transfer.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the Service, or access to it, without our written permission. Headings in these Terms are for convenience only.

3. Accuracy of information

We work hard to keep the information on this site accurate, complete and current, but it is provided for general information only. This site may contain historical information, which is not current and is provided for your reference only. We may update the site at any time.

4. Changes to the Service and prices

Prices for our products may change without notice. We may change or discontinue the Service (or any part of it) at any time. A price change won't affect an order we have already accepted.

5. Products

Some products may be available only online and in limited quantities. Returns and exchanges are covered by our Refund Policy, and warranty claims by our Warranty Guide.

We've made every effort to show the colours and images of our products as accurately as possible, but we can't guarantee your screen will display every colour accurately.

We may limit sales of our products to any person, region or jurisdiction, limit quantities, change product descriptions or pricing, or discontinue any product at any time. Any offer for a product on this site is void where prohibited.

6. Pricing and payment

All prices are in Australian dollars (AUD) and include GST. We accept Visa, Mastercard and Afterpay. We don't accept PayPal. If you pay with Afterpay, Afterpay's own terms also apply.

7. Delivery

Our own MYSWAN trucks deliver across metropolitan Melbourne. For regional Victoria and the rest of Australia, please contact us before you order. Delivery options, prices and timeframes are set out in our Shipping Policy and shown at checkout. White Glove Service is an optional add-on charged per product.

Click & Collect will be available from our new showroom from November 2026. Until then, all orders are delivered.

8. Orders and account information

We may refuse or cancel any order, or limit quantities per person, household or order, including orders placed with the same customer account, card, or billing or delivery address. If we change or cancel your order, we'll try to contact you using the email address or phone number you gave us, and we'll refund any amount you've paid for the cancelled items. We may limit or decline orders that appear to be placed by dealers, resellers or distributors.

You agree to give us current, complete and accurate purchase and account information, and to update it promptly, so we can complete your order and contact you.

9. Optional tools

We may give you access to third-party tools that we don't monitor or control. These are provided “as is” and your use of them is at your own discretion. Please make sure you're happy with the terms on which the relevant third party provides them.

10. Third-party links

Links on this site may take you to third-party websites that aren't affiliated with us. We aren't responsible for their content, accuracy, products or services. Please review a third party's policies before you deal with them, and direct any questions about third-party products to that third party.

11. Comments, feedback and other submissions

If you send us creative ideas, suggestions, competition entries or other materials (“comments”), you agree we may edit, copy, publish and otherwise use them in any medium, without any obligation to keep them confidential, pay for them or respond to them.

We may remove content we reasonably decide is unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that infringes anyone's intellectual property or these Terms. You agree your comments won't infringe anyone's rights, won't contain unlawful, abusive or obscene material or malware, and won't mislead anyone about who you are. You are responsible for any comments you make.

12. Personal information

Personal information you give us through the store is handled under our Privacy Policy.

13. Errors, inaccuracies and omissions

Occasionally there may be errors on our site about product descriptions, pricing, promotions, offers, delivery charges, delivery times or availability. We may correct them and change or update information, or cancel orders affected by an error (including after you have placed your order). If we cancel your order, we'll refund what you've paid for it.

14. Prohibited uses

You must not use the site or its content: (a) for any unlawful purpose; (b) to encourage others to break the law; (c) to breach any regulations, rules or laws; (d) to infringe our intellectual property or anyone else's; (e) to harass, abuse, insult, harm, defame, intimidate or discriminate against anyone; (f) to submit false or misleading information; (g) to upload or transmit viruses or other malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or get around the security features of the Service. We may end your use of the Service if you do.

15. Our liability

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in this section limits those guarantees or your rights and remedies under them.

Subject to that, we don't promise that the website will always be uninterrupted, timely, secure or error-free, and we may take the website offline from time to time. To the extent the law allows, we aren't liable for any indirect or consequential loss (such as lost profits or loss of data) arising from your use of the website.

16. Indemnity

You agree to indemnify Swan Beauty and our directors, employees, agents, contractors and suppliers against any third-party claim or demand, including reasonable legal costs, arising from your breach of these Terms or your breach of any law or anyone else's rights, except to the extent it was caused by us.

17. Severability

If any part of these Terms is found to be unlawful, void or unenforceable, it will be enforced to the fullest extent the law allows, and the rest of these Terms will still apply.

18. Termination

These Terms apply until either you or we end them. You can end them at any time by telling us you no longer wish to use the Service, or by stopping using the site. If you breach these Terms, we may end them and stop you using the Service. Obligations incurred before termination continue after it.

19. Entire agreement

These Terms and the policies posted on this site make up the entire agreement between you and us about the Service. If we don't enforce a right under these Terms, that doesn't mean we've waived it.

20. Governing law

These Terms are governed by the laws of Victoria and the Commonwealth of Australia, and you and we submit to the jurisdiction of the courts of Victoria.

21. Changes to these Terms

You can review the latest version of these Terms on this page at any time. We may update them by posting changes on our website, and the date at the top shows when they last changed. Continuing to use the site after a change means you accept it. Changes won't affect orders we've already accepted.
